With the ‘where there’s blame, there’s a claim’ culture on the increase, you don’t want to see all your hard work go down the drain because you didn’t recognise a hazard or you thought, ‘it must be safe because it was built by experts’.

 

The truth of the matter is that best practice standards change because accidents or incidents have occurred somewhere which have highlighted additional risks.

 

The change in best practice is to help you learn from the mistakes made by others.

 

If a claim is made against your facility, your insurance Company will cover any compensation that is awarded.

 

IF THE HEALTH AND SAFETY EXECUTIVE PROSECUTE YOU FOR THE ACCIDENT, ANY FINES ARE NOT COVERED BY THE INSURANCE COMPANY! - YOU MUST PAY THE FINES FROM THE BUSINESS TAKINGS.

 

THE UPPER LIMIT OF FINES ARE £250,000.00 OR UP TO 2YRS IMPRISONMENT.

 

As part of your duty of care under the ‘Health and safety at work act (1974)’, it is your responsibility to ensure that your play area is safe and free from undue risks.

 

The best practice that your facility should be working to is BS8409:2009.

 

The best practice that your play equipment should be designed, manufactured and installed by is BS:EN 1176:2008 and BS:EN 1177:2008.

 

Your insurance Company may insist that you have an annual inspection carried out by a competent person or you may do this as part of your best practice for your play area.  (This is recommended under BS8409).

 

With the in-house expertise available at King of the Castles, we are able to offer inspections that would satisfy your requirements under BS8409.  The equipment would be inspected and benchmarked against BS:EN 1176 and BS:EN 1177.  A certificate of inspection would be supplied to you as well as a report that would inform you about any non compliance issues and any repair related issues.  The report would also recommend what actions would need to be taken to bring you back in line with the standards.  The certificate and report would satisfy your requirements, whether it was for your own best practice, for your insurance requirements or to comply with your duty of care.
